1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Brewskr, LLC governing your use of the Brewskr app, website, and all related services (collectively, the "Services").

BY CREATING AN ACCOUNT OR USING THE SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

We may update these Terms at any time. Material changes will be communicated via in-app notification and email at least 30 days before they take effect.

2. Eligibility

You must be at least 17 years old to use the Services. By creating an account, you confirm you have the legal capacity to enter a binding agreement and that your use doesn't violate applicable law.

You may create only one Brewskr account. Creating multiple accounts to evade a ban is a material breach of these Terms.

3. Accounts & Registration

Your Handle

• You may change your handle (@username) at any time — maximum once per 14-day period
• Your previous handle is reserved for 30 days to prevent impersonation
• Handles may not impersonate real people, brands, or other users
• Handles containing hate speech or offensive content will be removed

Account Security

• Use a strong, unique password
• Do not share your credentials with anyone
• Notify us immediately at security@brewskr.com if you suspect unauthorized access
• You are responsible for all activity under your account

You're not required to use your real name — your handle and display name can be any non-offensive identifier.

4. Acceptable Use Policy

You May Use the Services To:

• Post Shoutouts and invite Circles to meet IRL
• Discover gatherings on the Good Vibes Map
• Use Tap to Connect (NFC/QR) to add new friends
• Interact with business venue profiles and Instant Specials
• Build and manage friend Circles
• Book safe rides home via Uber and Lyft integrations

Illegal Activities

• Using the Services for any unlawful purpose
• Facilitating drug transactions, trafficking, or any criminal activity
• Stalking, harassing, or threatening any person
• Violating any person's privacy rights

Harmful Content

• Defamatory, obscene, pornographic, or sexually explicit content
• Content that sexualizes, exploits, or endangers minors in any way
• Promotion of violence, terrorism, or self-harm
• Hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

Deception & Fraud

• Impersonating any person, business, or entity
• Creating fake venues, Shoutouts, or business profiles
• Sending spam or unsolicited commercial messages
• Scraping or data-mining content without written permission

Technical Abuse

• Attempting unauthorized access to accounts or Services
• Using bots, crawlers, or automated scripts
• Reverse engineering or decompiling the app
• Using location spoofing to falsify your location
• Using Tap to Connect without the consent of the other party

5. Content

You own your content. Brewskr does not claim ownership of what you post.

By posting content on Brewskr, you grant us a non-exclusive, royalty-free, worldwide license to display, store, and reformat your content to operate the Services. This license does not permit us to use your content in external advertising without your separate written consent.

We reserve the right to remove content that violates these Terms. You can report content in-app. Content standards: Shoutouts must be genuine meetup invitations — not ads or spam.

6. Location Services & NFC

By enabling location features, you consent to sharing your approximate venue-level location with other users when posting a Shoutout or opting into the Good Vibes Map. You can revoke location permission at any time in device Settings or Brewskr's Privacy Settings.

We do not warrant that location data or venue information is accurate or current. Do not rely on Brewskr for emergency services or navigation.

By using Tap to Connect, you consent to your device writing a temporary session token to an NFC tag (active only while the screen is open), and you represent that you have the consent of the other party to initiate a tap session.

7. Subscriptions, Payments & Billing

Free Tier

Core features including Shoutouts, basic Circle management, and limited interest tags — free forever.

Brewskr Social Premium — $2.99/month or $29.99/year

• Automatically renews unless cancelled through your app store account
• Non-refundable for partial billing periods except where required by law
• Cancel anytime through Apple App Store or Google Play

Business Subscriptions — $29/mo (Basic) or $79/mo (Pro)

• Plus one-time $49 setup fee
• Cancel with 30 days' notice
• Requires acceptance of Business Partner Terms

Instant Specials

Charged at submission ($5–$25 per push). Non-refundable once delivered to users.

Payments processed by Stripe. We never store full card details. Price changes come with 30 days' notice.

8. Intellectual Property

The Brewskr name, logo, brand identity, app design, code, and features are owned by Brewskr, LLC and protected by intellectual property law. You may not copy, modify, or distribute any part of the Services without written permission.

9. Third-Party Services

Brewskr integrates with Uber, Lyft, Facebook, X (Twitter), Apple Sign-In, Google Sign-In, Google Maps, and Stripe. Your use of these services is governed by their own terms. We are not responsible for third-party content or practices.

10. Disclaimers & Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that the Services will be uninterrupted or error-free. We are not responsible for the actions, content, or behavior of other users.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF: (A) $100 USD, OR (B) THE AMOUNT YOU PAID TO BREWSKR IN THE PRECEDING 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless Brewskr, LLC from any claims, damages, and costs (including attorneys' fees) arising out of your use of the Services, your content, your violation of these Terms, or your violation of any third party's rights.

12. Account Suspension & Termination

By you: Delete your account anytime at Settings → Account → Delete Account. Data removed within 30 days. No refund of subscription fees.

By Brewskr: We may suspend or terminate your account anytime for Terms violations. We'll notify you when legally permitted. Sections 5, 8, 10, 11, 13, and 14 survive termination.

13. Dispute Resolution

Informal Resolution First

Before any formal claim, contact legal@brewskr.com. We'll make a good-faith effort to resolve the dispute within 30 days.

Binding Arbitration

IF WE CAN'T RESOLVE THE DISPUTE INFORMALLY, YOU AGREE TO BINDING INDIVIDUAL ARBITRATION — NOT COURT.

• Conducted by JAMS (jamsadr.com) under Streamlined Arbitration Rules
• Location: Wichita Falls, Texas, or via videoconference
• Each party bears its own attorneys' fees unless the claim is found frivolous

Governing Law

These Terms are governed by the laws of the State of Texas. Non-arbitration matters: state and federal courts in Wichita Falls, Texas.

14. General Provisions

Entire Agreement: These Terms + our Privacy Policy = the complete agreement between you and Brewskr.

Severability: If any provision is unenforceable, it's modified to the minimum extent necessary. Remaining provisions stay in force.

No Waiver: Our failure to enforce any provision isn't a waiver of that provision.

Assignment: You may not assign your rights without our written consent. We may assign ours in connection with a merger or acquisition.
